Terms of Service

Last updated: 16 May 2026

These terms are written for Jiko New Zealand.

1. Who these terms apply to

These Terms of Service apply when you access or use Jiko, including the website, app, dashboard, forms, records, exports, and any related services. In these terms, Jiko, we, us, and our refer to Jiko New Zealand. You and your refer to the person or business using Jiko.

By creating an account, starting a trial, logging in, or using Jiko, you agree to these terms. If you are using Jiko for a business, you confirm that you have authority to accept these terms for that business.

2. What Jiko does

Jiko is designed to help food businesses record kitchen compliance information, including checks, tasks, temperature records, supplier records, delivery records, cleaning records, user activity, and downloadable reports.

Jiko is a record keeping and workflow tool. It does not replace your responsibility to understand and follow the food safety laws, regulations, council requirements, audit obligations, or operating procedures that apply to your business.

3. Your account

You must provide accurate information when creating and using your account. You are responsible for keeping your login details secure and for all activity that occurs under your account.

You must tell us promptly if you believe your account has been accessed without permission. We may suspend or restrict access if we reasonably believe an account is being misused, is insecure, or is being used in a way that may harm Jiko or other users.

4. Free trials and subscriptions

Jiko may offer a free trial for new users. The trial period, features, pricing, payment timing, and renewal terms will be shown during signup or checkout.

If payment details are required, you authorise us or our payment provider to charge the applicable subscription fees when the trial ends, unless you cancel before the trial converts to a paid plan.

Subscription fees may be charged monthly, annually, or on another billing cycle shown at the time you subscribe. Unless stated otherwise, subscriptions renew automatically until cancelled.

5. Cancellations and refunds

You can cancel your subscription by following the cancellation process provided in Jiko or by contacting us at support@jiko.co.nz. Cancellation will stop future billing, but it may not automatically create a refund for amounts already charged.

If you are using Jiko as a consumer under New Zealand law, nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If Jiko is supplied for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply to the fullest extent permitted by law.

6. Acceptable use

You must use Jiko lawfully and responsibly. You must not use Jiko to upload unlawful material, interfere with the service, attempt to access another user’s account, reverse engineer the app, copy substantial parts of the app, introduce malicious code, or use Jiko in a way that could damage our systems, reputation, or other users.

You are responsible for the accuracy of the information entered into Jiko by you or your staff. We do not verify whether your records are complete, accurate, compliant, or suitable for a particular audit or inspection.

7. Food safety and compliance responsibility

Jiko may help you organise and export compliance records, but you remain responsible for your own food safety programme, food control plan, national programme obligations, staff training, operational checks, corrective actions, and any communication with regulators or verifiers.

You should seek guidance from your verifier, local council, Ministry for Primary Industries, lawyer, accountant, or another qualified adviser when needed.

8. Your data and records

You own the kitchen records, business information, and other content that you enter into Jiko. You give us permission to store, process, back up, display, and transmit that information so we can provide Jiko to you.

You are responsible for keeping your own copies of important records. Although we aim to keep Jiko reliable, we cannot promise that records will never be lost, delayed, corrupted, or unavailable.

9. Privacy

We collect and handle personal information in accordance with our Privacy Policy. The Privacy Policy explains what information we collect, why we collect it, how we use it, when we may share it, and how you can ask to access or correct it.

10. Third party services

Jiko may rely on third party providers for hosting, authentication, payments, analytics, email delivery, backups, and other technical services. These providers may process information on our behalf so Jiko can operate.

We are not responsible for third party websites, platforms, or services that we do not control, even if they are linked from Jiko.

11. Availability and changes

We aim to provide a reliable service, but Jiko may be unavailable from time to time due to maintenance, upgrades, outages, internet issues, provider issues, security concerns, or events outside our control.

We may update, improve, limit, suspend, or remove features where reasonably necessary. If a change has a material negative effect on a paid plan, we will try to give reasonable notice where practical.

12. Intellectual property

Jiko, including its design, software, branding, workflows, templates, text, layouts, and related materials, is owned by us or licensed to us. You may use Jiko only as permitted by these terms.

You must not copy, sell, resell, licence, modify, or create competing products from Jiko unless we have given written permission.

13. Confidentiality

If you receive information from us that is clearly confidential or should reasonably be treated as confidential, you must not disclose it unless required by law or approved by us in writing.

14. Warranties and disclaimers

We will provide Jiko with reasonable care and skill. However, Jiko is provided as a practical software tool and we do not guarantee that it will meet every legal, audit, operational, or business requirement for your particular kitchen.

To the fullest extent permitted by law, we exclude all warranties, conditions, guarantees, or representations that are not expressly stated in these terms or required by law.

15. Liability

To the fullest extent permitted by law, we are not liable for indirect loss, loss of profit, loss of revenue, loss of goodwill, loss of business opportunity, loss of data, failed audits, regulatory action, or operational decisions made from information entered into Jiko.

If we are liable to you for any reason, our total liability is limited to the amount you paid for Jiko in the three months before the event giving rise to the claim, unless the law does not allow that limit.

16. Indemnity

You agree to indemnify us against losses, costs, claims, and expenses arising from your misuse of Jiko, your breach of these terms, your unlawful conduct, or information entered into Jiko by you or your authorised users.

17. Suspension and termination

We may suspend or terminate access if you breach these terms, fail to pay fees, misuse the service, create security risk, or use Jiko in a way that may harm us or others.

You may stop using Jiko at any time. Some terms will continue after termination where they are intended to survive, including terms about payment, intellectual property, confidentiality, liability, privacy, and dispute resolution.

18. Changes to these terms

We may update these terms from time to time. If the changes are material, we will take reasonable steps to notify you, such as by showing a notice in Jiko or sending an email. Continued use of Jiko after the updated terms take effect means you accept the updated terms.

19. Governing law

These terms are governed by the laws of New Zealand. You and we submit to the non exclusive jurisdiction of the New Zealand courts.
